Panyero - Terms of Service

Welcome to Panyero ("the App"), a Philippine law quiz and bar exam reviewer application developed by Jun Auza ("Developer", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
1. Description of Service
Panyero is an educational mobile application that provides multiple-choice quiz questions, flashcards, and study tools for the Philippine Bar Examination. The App covers eight (8) bar exam subjects: Political Law, Civil Law, Criminal Law, Labor Law, Commercial Law, Taxation Law, Remedial Law, and Legal Ethics.
2. Educational Purpose Only
The content provided in the App is for educational and review purposes only. The App is not a substitute for formal legal education, professional legal advice, or official bar review courses. While we strive for accuracy, we do not guarantee that all questions, answers, explanations, or flashcard content are free from errors. Users should verify information independently and consult qualified legal professionals for legal advice.
3. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement.
4. User Accounts and Data
The App stores your progress data, bookmarks, quiz results, and preferences locally on your device using standard iOS storage mechanisms. We do not collect, transmit, or store your personal data on external servers. If you delete the App, your locally stored data will be permanently lost.
5. Free and Premium Plans
The App offers both free and premium tiers:
- Free Plan: Access to three (3) subjects (Political Law, Civil Law, Criminal Law) with a daily limit of 20 questions.
- Premium Plan: Unlimited access to all eight (8) subjects, all quiz modes, flashcards, and features. Premium is available through auto-renewable subscriptions (monthly or annual).
6. Subscriptions and Payments
- Premium subscriptions are billed through your Apple ID account via the App Store.
- Payment is charged at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage and cancel your subscriptions at any time through your Apple ID Account Settings in the App Store.
- No refunds will be provided for any unused portion of a subscription period. Refund requests must be directed to Apple in accordance with their refund policies.
- Prices are subject to change. Any price changes will take effect at the start of the next subscription period following the date of the price change.
7. Free Trial
We may offer a free trial period for Premium subscriptions. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the applicable rate. Free trial eligibility is determined by Apple and may be limited to one trial per Apple ID.
8. Promotional and Offer Codes
From time to time, we may offer promotional codes or offer codes that provide free or discounted access to Premium features. These codes are subject to their own terms, are non-transferable, and may not be redeemed for cash.
9. Legacy Users
Users who purchased the original paid version of Panyero (prior to the transition to the freemium model) are entitled to lifetime Premium access at no additional cost as a token of appreciation for their early support.
10. Intellectual Property
All content in the App, including but not limited to quiz questions, explanations, flashcards, design, graphics, and code, is the intellectual property of the Developer or used with appropriate authorization. You may not reproduce, distribute, modify, or create derivative works from the App's content without prior written consent from the Developer.
11. Acceptable Use
You agree not to:
- Copy, reproduce, or redistribute the App's content in any form.
- Reverse-engineer, decompile, or disassemble the App.
- Use the App for any unlawful or unauthorized purpose.
- Attempt to circumvent the App's subscription or free-tier limitations.
- Scrape, harvest, or extract data from the App through automated means.
12. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or failure to pass the bar examination, arising out of or in connection with your use of the App.
14. Indemnification
You agree to indemnify and hold harmless the Developer from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted within the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
16. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Philippines.
